Vayva Technologies Ltd Prohibited Items Policy
This Prohibited Items Policy defines the categories of goods and services that may not be listed, sold, promoted, or transacted through the Vayva Platform. This policy is enforced in accordance with Nigerian law, including the Criminal Code Act, the National Drug Law Enforcement Agency Act, the Arms and Ammunition Act, NAFDAC regulations, CBN guidelines, and the Vayva Terms of Service. Merchants are responsible for ensuring that all products and services listed on their storefronts comply with this policy at all times.
The following items are strictly prohibited: firearms, ammunition, and their components; explosives, fireworks, and pyrotechnics; knives designed or marketed as weapons (switchblades, butterfly knives, ballistic knives); pepper spray, tear gas, and stun guns; bows, crossbows, and air guns intended for combat; and any item classified as a weapon under the Arms and Ammunition Act of Nigeria.
The sale of the following is prohibited: illegal narcotics and controlled drugs as defined by the NDLEA Act; prescription medications without valid pharmaceutical licensing; unregistered or unapproved drugs and pharmaceuticals; drug paraphernalia designed for consuming illegal substances; synthetic cannabinoids and designer drugs; and substances banned by NAFDAC.
Merchants may not list: counterfeit branded products bearing unauthorized trademarks; pirated software, music, movies, or digital content; replica goods designed to deceive buyers; unauthorized copies of copyrighted materials; and products bearing forged certificates of authenticity.
The following categories are prohibited: human organs, tissues, or remains; endangered species, wildlife products, or products violating CITES; stolen goods or property obtained through criminal activity; gambling devices not licensed by the National Lottery Regulatory Commission; adult content, pornography, or sexually explicit materials; tobacco products, e-cigarettes, and vaping devices; hazardous materials, toxic chemicals, or radioactive substances; unlicensed financial products, investment schemes, or forex trading services; and products that violate sanctions or trade restrictions.
The following items may only be sold with prior written authorization from Vayva and valid regulatory licenses: alcohol and alcoholic beverages (requires state liquor license); pharmaceuticals and health supplements (requires NAFDAC registration); agricultural chemicals and pesticides (requires NAFDAC approval); financial advisory services (requires SEC or CBN license); and medical devices (requires NAFDAC clearance).
Vayva employs automated scanning, manual review, and user reports to identify prohibited items. When a prohibited item is detected: the listing is immediately removed; the merchant receives a written notice; repeated violations result in account suspension or permanent termination; Vayva may freeze wallet funds pending investigation; and Vayva will report serious violations to the Nigeria Police Force, NDLEA, NAFDAC, CBN, or other relevant authorities.
Merchants are solely responsible for ensuring that all products listed on their storefronts comply with this policy and all applicable Nigerian laws. Ignorance of this policy does not excuse violations. Merchants must regularly review this policy as it may be updated to reflect changes in legislation.
Vayva is under no obligation to proactively monitor, screen, or audit merchant listings for compliance with this policy. The responsibility for ensuring product compliance rests solely with the merchant. Vayva's failure to detect a prohibited item listing does not constitute approval or acceptance of that listing.
Vayva reserves the right to add, remove, or reclassify items in this prohibited items list at any time without prior individual notice. Changes take effect upon posting to the Platform. Merchants are responsible for monitoring this policy and removing any newly prohibited items within 48 hours of the policy update.
Merchants shall indemnify, defend, and hold harmless Vayva from all claims, damages, losses, liabilities, regulatory fines, penalties, and expenses (including reasonable legal fees) arising from: the listing or sale of prohibited items on the merchant's storefront; the merchant's failure to comply with this policy; any harm caused to consumers or third parties by prohibited items listed by the merchant; and regulatory actions or enforcement proceedings resulting from the merchant's listing of prohibited items.
Vayva's enforcement of this policy, including removal of listings, suspension of accounts, or reporting to authorities, does not create any duty of care to any merchant or third party. Vayva does not guarantee that the Platform will be free from all prohibited items. Vayva shall not be liable for any loss of business, revenue, or goodwill resulting from enforcement actions taken under this policy. Vayva exercises enforcement discretion solely at its own judgment and is not required to treat all violations identically.
